Important Update: Renters’ Rights Act

Renters' Rights Act has now passed Royal Assent and has become law. Implementation dates have not yet been confirmed, read on to see how the new act may affect you.

For everyone else, please read carefully — this legislation will bring major changes to how rental properties are managed across England.
The Renters’ Rights Act officially passed Royal Assent on 27th October and is now law.

This landmark reform introduces the biggest shake-up in the private rental sector in decades. Implementation dates are still to be confirmed, but every landlord needs to understand what’s coming.

Below is a summary of the key changes and how they may affect you as a landlord:

🔁 All Tenancies to Become Periodic

Fixed-term ASTs will be replaced with rolling tenancies.

• Tenancies will automatically continue until notice is given.
• Landlords: must wait 12 months before serving notice for possession.
• Tenants: can leave at any time with two months’ notice.

🚫 End of Section 21 (‘No Fault’) Evictions

Section 21 evictions will be abolished. Landlords will no longer be able to evict tenants without a valid legal reason. Possession will only be granted under specific grounds—such as rent arrears, breach of tenancy terms, or where the landlord genuinely intends to sell or move into the property.

🏠 Notice Periods When Selling or Moving In

If a landlord intends to sell or move into their property, they must now provide a minimum of four months’ notice. Once notice is served on these grounds, the property cannot be marketed or re-let for 12 months.

💷  Rent in Advance Restrictions

Landlords will now only be able to request up to one month’s rent in advance, regardless of circumstances. This marks a major change for those letting to students or tenants who do not meet affordability thresholds.

📈 Rent Increases

• Limited to once per year.
• Two months’ written notice required.
• Tenants can challenge increases via a formal tribunal.
• Every adjustment must include a clear written justification.

💬 Advertising Rules

Rent bidding and the practice of inviting or accepting offers above the advertised price will be prohibited. All listings must include a transparent single asking rent, and landlords and agents must treat all applicants fairly and consistently.

🐶 Pets and Tenant Discrimination

Blanket bans such as ‘No DSS’ (Housing Benefit) or ‘No Pets’ will no longer be permitted. Tenants will have the right to request permission to keep pets, and landlords will be required to provide reasonable grounds if refusing.

🧾New Landlord Ombudsman Scheme

Every landlord will need to:
• Join the new Landlord Ombudsman Scheme
• Register their properties on a national database

📅 What Happens Next

The government hasn’t confirmed implementation dates yet, but the main reforms are expected to start from early 2026, rolled out in stages.
