Here are the Legal Steps of Selling Your Property — What You Need to Know

We thought it might be helpful to outline the key steps involved when selling — focusing specifically on the legal and administrative side of things.

1️⃣ Appointing a Solicitor (Conveyancer)
The moment you decide to place your property on the market, it's a very good idea to appoint your solicitor early. A solicitor (or licensed conveyancer) will handle all the legal work for your sale.
Starting early means:
  • The legal paperwork (known as title deeds) can be gathered in advance.
  • You can complete your property information forms (such as TA6 and TA10), which provide buyers with important details about your home (e.g. boundaries, guarantees, planning permissions, service charges if leasehold, etc.).
  • You’ll be legally prepared and ready to move quickly when a buyer is found — this can dramatically speed up the entire process.

2️⃣ Legal Documents You’ll Need to Provide
To comply with UK law, there are certain documents you’ll need as a seller:
Proof of identity and address (to satisfy anti-money laundering regulations).
Title Deeds — proof that you legally own the property.
Property Information Forms (TA6, TA7, TA10) — completed questionnaires covering everything from boundaries to disputes, utilities to alterations.
Energy Performance Certificate (EPC) — this is legally required to market the property. If you don’t have a current EPC, we will arrange this for you.
Warranties, guarantees, and certificates — if you’ve had any building work done (extensions, loft conversions, windows, boilers), you may need to provide building regulations certificates, planning permissions, and warranties.

3️⃣ What Happens Once You Accept an Offer
Once a buyer makes an offer and you accept, your solicitor’s real work begins:
  • Draft the contract of sale and send it to the buyer’s solicitor.
  • Answer any pre-contract enquiries raised by the buyer’s legal team.
  • Liaise with your mortgage lender (if applicable) to obtain a redemption statement for your mortgage balance.
  • Negotiate and agree any outstanding terms between both parties.
  • Set a target exchange and completion date.

During this stage, we stay fully involved — proactively managing communication between solicitors, buyers, and brokers to keep everything moving.

4️⃣ If You Are Buying Onwards
If you are purchasing another property, there are additional legal stages you will go through:
  • Your solicitor will order searches (local authority, drainage, environmental).
  • You may arrange a survey (homebuyer report or full structural survey depending on the property type and condition).
  • Your mortgage lender will carry out a valuation survey.
  • Contracts for your sale and purchase will be exchanged simultaneously (if you are in a chain), and a completion date will be agreed.
